The Faculty of Law at the University of Karbala discussed the master’s thesis tagged: “The Relationship of the Government of the Conduct of Daily Matters to the Other Authorities in the Light of the Constitution of the Republic of Iraq for the year 2005” (a comparative study). The message was submitted by the student Noha Hadi Talib.
The study aimed to demonstrate the need for a temporary prime minister during this short period, i.e. this temporary position itself derives from a very important constitutional principle; It is to ensure the continuity of administrative work and public utilities regularly and steadily. The importance of shedding light on the issue of parliamentary oversight over the actions taken by the interim Prime Minister during that period is responsible for everything that is taken by him; Because this work is a responsibility that must be taken into account by it.
The study also showed that the state of power vacuum is achieved in the absence of the head of state, the prime minister or the speaker of parliament for any reason, such as death, dismissal or resignation, and that the presence of the presidency of the Council of Ministers is important at the head of the authority to handle urgent daily matters required by exceptional circumstances and the situation Necessity and it includes all that is outside the practice of this government under normal circumstances.
In the conclusion, the researcher reached a number of results and proposals, the most important of which is that the government of managing daily affairs has a number of justifications imposed by the practical reality represented in the necessity of the continuation of the public facility regularly and steadily, and to ensure the achievement of the public interest. Also, the Constitution of the Republic of Iraq of 2005 did not stipulate a specific period for the Prime Minister to assume power. It was determined on the basis of the correlation between the term of the Parliament and the term of the President of the Republic.
Therefore, the researcher recommends the necessity of explicitly stipulated in the Constitution of the Republic of Iraq for the year 2005 a period of time during which it is not allowed to dissolve the House of Representatives as is the case with the rest of the constitutions, with the need not to adopt a self-dissolution and it is better to adopt a ministerial solution, that is, by the government and this is one of the principles on which the system is based. Parliamentary.
